USERS

In order to purchase any of the products displayed by H SPORT WEAR S.L.U., you must have the legal capacity to do so in accordance with Spanish law.

PURCHASE OF STANDARD (COLLECTION) PRODUCTS

Standard or collection products are those that you can purchase from HSPORTWEAR without requesting their individualisation.

When purchasing standard products, by clicking on the “buy” button you make a binding offer to purchase. Before submitting the binding order, you may review the order details (goods, quantity, price, shipping and payment method) at any time and, where applicable, modify them. The ordering process may be cancelled at any time by leaving the order process.

Confirmation of receipt of the order is sent by automatic email immediately after the order has been submitted; this does not constitute acceptance of the offer by HSPORTWEAR.

In the event of a computer or technical error resulting in an incorrect price being displayed, HSPORTWEAR reserves the right to cancel and refund the relevant order.

PURCHASE OF CUSTOM WORKS (PERSONALISED PRODUCTS)

Personalised products are those that have been individualised by the client and are therefore manufactured according to their preferences, for example, with a particular design or colour or with the addition of logos. HSPORTWEAR will send you the prices and conditions applicable to the personalisation of the product by email.

The client will receive the proof design, quotation and delivery conditions for verification and may send HSPORTWEAR their confirmation in writing or by email within two weeks following receipt of the quotation. Upon receipt of such confirmation, the contract shall be deemed concluded. HSPORTWEAR will then send a brief confirmation by email.

The client may consult the specific conditions applicable to orders for  personalised products in the relevant section of our website.

TEAM STORE / PRE-ORDER TERMS AND CONDITIONS

TEAM STORE / PRE-ORDER products are part of H SPORT WEAR S.L.U. and are governed by the Terms of Use applicable to hsportwear.com, except as specified below.

1. All orders placed through the TEAM STORE / PRE-ORDER shall be considered FINAL and DEFINITIVE, including, among other aspects, the design, size, quantity and garments purchased, once the ordering period has expired. Returns of garments will not be accepted, as these are personalised garments manufactured specifically and on demand.

An order shall be considered confirmed ONLY when the following requirements have been met:

    • Online order confirmation, after all order details have been completed.
    • Payment of the indicated amount.

The absence of either of these two conditions shall, for all purposes, be considered an invalid order, with no possibility of a claim by the client once the order management period has expired.

No changes to the order will be accepted once the order management period has ended, at which point the manufacturing process for the personalised garments will begin.

    2. Production of the overall order will begin on the 15th day of each month, regardless of the minimum order quantity for each style.

    3. The TEAM STORE / PRE-ORDER group administrator shall be designated as HSPORTWEAR's point of contact and shall be responsible for transmitting information in both directions where applicable.

    4. All orders processed through the TEAM STORE / PRE-ORDER will be manufactured from the date on which the ordering period closes, in accordance with the delivery times previously agreed with the administrator.

    5. Delivery dates are estimates and depend on the volume and complexity of the overall order.

    6. Returns of any item purchased through TEAM STORE / PRE-ORDER will not be accepted, except in the event of manufacturing defects.

    PRICES

For customers within the European Union (EU), the prices indicated are final prices. They include the applicable taxes, in particular VAT and all other components of the price. Shipping costs will be detailed separately on the invoice.

For customers outside the EU, all prices indicated shall be understood as net prices. The determining factor is the delivery address. If, in accordance with the legal provisions of the country of destination, value added tax is applicable, this must be paid additionally upon receipt of the goods. Import duties may also apply and must be paid additionally by the customer upon receipt of the goods. The aforementioned amounts will be collected either by the customs authorities or by the transport company responsible for the shipment.

The price also includes transport and packaging costs. The customer shall pay a flat-rate shipping charge, which may vary depending on the value of the order and the destination to which it must be shipped, including any possible surcharge for delivery to a remote area.

Payment may be made using any of the following methods:

    • Credit or debit card: all information will be processed through the bank's payment gateway.
    • Bank transfer.

    RETENTION OF TITLE

The goods shall remain the property of HSPORTWEAR until all payment obligations included in the shipping contract have been fully satisfied (retention of title).

The customer is obliged to handle and care for the goods properly until ownership is transferred and the goods become their property.

HSPORTWEAR reserves ownership and copyright over the illustrations, designs, drawings, calculations and other documents provided to the customer. This also applies to written documents that have not been designated as confidential. Before granting third parties access to such documents, the customer must obtain HSPORTWEAR's express written consent.

    LIABILITY

HSPORTWEAR excludes liability towards the customer for slight negligence, provided that such negligence does not concern essential contractual obligations, damages arising from injury to life, body or health, or guarantees arising under applicable product liability legislation. The same shall apply to breaches committed by HSPORTWEAR's agents or legal representatives. An essential contractual obligation means an obligation whose fulfilment enables the proper performance of the contract or upon whose fulfilment the customer may and must rely.

HSPORTWEAR's liability towards a business customer for slight negligence concerning an essential contractual obligation shall be limited to foreseeable and typical damages.

COPYRIGHT, THIRD-PARTY RIGHTS, INDEMNIFICATION, PROHIBITED DESIGNS

If the customer provides their own artwork or otherwise exercises any form of influence over the product (e.g. text personalisation), the customer warrants to HSPORTWEAR that such design, text and artwork are free from third-party rights. The customer shall be solely responsible for any infringement of copyrights, rights relating to samples or images, personality rights or name rights. The customer also warrants that they will not infringe any third-party rights when personalising the product. In particular, when using legally protected logos, images, slogans, fonts or designs, the customer is responsible for obtaining written authorisation from the legal owner and providing such authorisation to HSPORTWEAR upon request.

The customer shall indemnify and hold HSPORTWEAR harmless from all claims and rights asserted due to the infringement of such third-party rights, provided that the customer is responsible for the breach of the relevant obligation. The customer shall bear all costs of defence and any other damages incurred by HSPORTWEAR.

Designs containing images, inscriptions or other customer requests that infringe the privacy or rights of third parties, contain pornography, are intended for the distribution of prohibited propaganda, or incite the commission of criminal offences or participation therein, will not be produced by HSPORTWEAR.
